GROCERY BOX END USER LICENSE AGREEMENT

This End User License Agreement (the "Agreement") is a legal agreement between you and ROSE, trading as Rose Development ("RoseDev", "we", "us", or "our"), for the Grocery Box mobile application, including its content, documentation, and updates (the "App"). This Agreement is concluded between you and RoseDev only, not Apple Inc. ("Apple"). RoseDev, not Apple, is solely responsible for the App and its content.
By downloading, installing, or using the App, you agree to this Agreement. If you do not agree, do not install or use the App.
SCOPE OF LICENSE
RoseDev grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App on Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and the applicable App Store Usage Rules. The App may also be accessed and used by other accounts associated with the purchaser through Family Sharing, volume purchasing, or Legacy Contacts where Apple permits this.
The App is licensed, not sold. RoseDev and its licensors reserve all rights not expressly granted to you.
RESTRICTIONS
Except where applicable law or an applicable open-source license expressly permits it, you may not:
copy, distribute, rent, lease, lend, sell, sublicense, or commercially exploit the App;
reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works from the App;
remove or alter copyright, trademark, or other proprietary notices; or
use the App in a way that violates applicable law, infringes another person's rights, interferes with the App or an external service, or introduces malicious code.
APP FUNCTIONALITY AND LOCAL DATA
Grocery Box lets you create and manage grocery lists, scan or enter barcodes, store product details, schedule local reminders, organize products, and share or import lists. The App stores your grocery information locally on your device and does not provide a RoseDev account or cloud-sync service.
You are responsible for the information you enter, the accuracy of your lists, maintaining appropriate device backups, and protecting access to your device. Depending on your Apple settings, App data may be included in an iCloud or computer backup.
EXTERNAL PRODUCT, IMAGE, AND PRICE SERVICES
The App may contact third-party product databases, image hosts, and price services, including Open Food Facts, Open Beauty Facts, Open Pet Food Facts, Open Products Facts, GTIN Hub, UPCitemdb, Go-UPC, and Open Prices (collectively, "External Services"). These services may change, become unavailable, impose limits, or return incomplete, outdated, or inaccurate information.
Product descriptions, ingredients, allergens, nutrition information, labels, images, prices, store information, and other third-party data are provided for general information only. Always verify critical information on the product packaging and confirm the actual price and availability with the retailer. Grocery Box does not provide medical, dietary, allergy, financial, or professional advice.
Your use of External Services is at your own risk and is subject to the applicable third-party terms. You must comply with those terms and with your internet or wireless-data service agreement. RoseDev does not control and is not responsible for the content, accuracy, availability, security, or processing practices of External Services, except to the extent responsibility cannot lawfully be excluded.
PRIVACY
RoseDev's handling of personal data in connection with the App is described in the Grocery Box Privacy Statement published at https://rosedev.nl/apps/grocerybox/privacy/. The Privacy Statement forms part of this Agreement. External Services, Apple, backup providers, and any destination you select when sharing data process information under their own privacy notices.
USER SHARING AND IMPORTED CONTENT
The App lets you choose to share list text, product images, or a Grocery Box list file. You are responsible for ensuring that you have the right to share that content and that it does not violate law or another person's rights. Once you share content, the recipient or destination service controls its further use.
You are responsible for checking imported files and for keeping a backup before importing. RoseDev does not guarantee that third-party or modified files will be compatible, complete, safe, or accurate.
INTELLECTUAL PROPERTY
The App, its design, software, original content, trademarks, and documentation are owned by RoseDev or its licensors and are protected by intellectual-property laws. Product data, images, names, brands, and other third-party materials remain the property of their respective owners and may be subject to separate licenses or terms.
If a third party claims that the App, or your possession and permitted use of it, infringes that party's intellectual-property rights, RoseDev, not Apple, is solely responsible for investigating, defending, settling, and discharging that claim.
MAINTENANCE AND SUPPORT
RoseDev is solely responsible for any maintenance and support for the App that it agrees to provide or that applicable law requires. Apple has no obligation to provide maintenance or support for the App.

UPDATES AND CHANGES TO THE APP
RoseDev may provide updates, corrections, changes, or new versions of the App. An update may be required for continued use. Features or External Services may be changed, suspended, or discontinued where reasonably necessary, subject to applicable law. Unless an update is accompanied by a separate agreement, this Agreement applies to it.
WARRANTY AND APP STORE REFUND
The App is provided "as is" and "as available" to the maximum extent permitted by law. RoseDev does not guarantee uninterrupted or error-free operation, permanent availability of External Services, or the completeness or accuracy of third-party product or price information.
Nothing in this Agreement excludes or limits any warranty, remedy, or statutory right that cannot lawfully be excluded or limited. RoseDev remains solely responsible for warranties concerning the App to the extent they apply and are not validly disclaimed.
If the App fails to conform to an applicable warranty, you may notify Apple. Apple may refund the purchase price paid for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation concerning the App. Any other claim, loss, liability, damage, cost, or expense resulting from a failure to conform to a warranty is RoseDev's responsibility to the extent required by applicable law.
PRODUCT CLAIMS
RoseDev, not Apple, is responsible for addressing claims by you or a third party relating to the App or your possession or use of it, including product-liability claims, claims that the App does not meet a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar law. This Agreement does not limit RoseDev's liability beyond what applicable law permits.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, RoseDev is not liable for indirect, incidental, special, or consequential loss, loss of profit, loss of opportunity, or loss of data arising from use of or inability to use the App or an External Service, where such loss was not reasonably foreseeable when you accepted this Agreement.
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, wilful misconduct, breach of obligations that cannot lawfully be limited, or any mandatory consumer right. You may have additional rights under the law of your country of residence.
TERMINATION
This Agreement continues until terminated. You may terminate it by deleting the App from all devices you own or control. Your license terminates automatically if you materially breach this Agreement. Upon termination, you must stop using and delete the App. Provisions that by their nature should survive termination will continue to apply.
LEGAL AND EXPORT COMPLIANCE
You represent and warrant that you are not located in a country or region subject to a United States Government embargo or designated by the United States Government as supporting terrorism, and that you are not listed on any United States Government list of prohibited or restricted parties.
You must not use, export, or re-export the App except as authorized by United States law, the law of the jurisdiction where you obtained the App, and other applicable law.
GOVERNING LAW AND DISPUTES
This Agreement is governed by the laws of the Netherlands, excluding its conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of habitual residence. A consumer may bring a claim in any court that has jurisdiction under applicable consumer law. In other cases, the competent courts in the Netherlands have exclusive jurisdiction.
GENERAL TERMS
This Agreement and the incorporated Privacy Statement are the entire agreement between you and RoseDev regarding the App, without limiting any applicable Apple terms. If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. RoseDev may assign this Agreement as part of a merger, reorganization, or transfer of the App or business, subject to applicable law. You may not assign it without RoseDev's prior written consent.
APPLE AS THIRD-PARTY BENEFICIARY
You and RoseDev acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this Agreement. When you accept this Agreement, Apple is deemed to have accepted the right to enforce this Agreement against you as a third-party beneficiary.
